GENERAL TERMS AND CONDITIONS

1 . VALIDITY

These general conditions apply to:

  • the purchase of products on the www.evorive.com website made by Professional Buyers, defined as follows.

2 . DEFINITIONS

a) The “Seller” is s.r.l. Evorive, p. IVA 11567920019, with registered office in Via Grange Palmero, 135 – 10091 Alpignano (TO), R.E.A. TO – 1223490. The contact details are indicated in the “contacts” section of this website.

b) The Professional Buyer is the subject, natural or legal person, who acts for purposes related to the entrepreneurial, commercial, craft or professional activity carried out, and for purposes related to this activity concludes an online sales contract for the purchase of one or more products of the Seller.

c) The “Consumer” is the natural person who acts for personal purposes, unrelated to any entrepreneurial, commercial, craft or professional activity performed.

d) “User” means the visitor of the website www.evorive.com who interacts with the functions of the site. The definition also includes the notion of Professional Buyer.

d) the “Contract” is the purchase and sale contract, concerning the movable goods offered on this website www.evorive.com, concluded between the Seller and the Professional Buyer, or person acting in the name or in the interest of the Professional Buyer.

3 . ORDERS / PURCHASES ON OUR WEBSITE

The conclusion of a contract for the purchase of products through the website www.evorive.com is only reserved for Professional Buyers and those acting in the name or in the interest of a Professional Buyer. Consumers are excluded from purchasing products.

How to order

Placing an order on our website is very simple:

  1. Select the product
  2. Choose the features
  3. Define the quantity
  4. Add the product to the cart
  5. Proceed to checkout
  6. Register
  7. Select your delivery and billing options
  8. Check the order
  9. Submit your order

The user is bound to the order once he/she clicks the “Submit order” button at the end of the ordering process. By clicking on the “Submit order” button, we receive the order as it appears in the final checkout screen. Once the order has been received, an automatic confirmation receipt containing the order number and purchase details will be displayed on the Website. The Contract is now concluded, except as provided in the following paragraph “Availability”. A copy of the automatic confirmation receipt will be sent to your e-mail address. We strongly suggest that you print or download this copy for future reference.

4 . PRICE/PAYMENT

Methods of payment

The payment methods available are:

  • PayPal
  • Wire transfer

We do not accept payment methods other than those mentioned above, as our system is not designed to accept other payment methods. Please do not try to pay in ways other than those specified therein. Otherwise, we will not be liable for the loss of payment or for any other damages resulting from such action.

Payment procedure

If the payment is done by credit card, we will debit the amount from your account as soon as your order for a product is shipped from our warehouse.

Attention, if the payment is done by bank transfer, we will ship your order only after receiving the payment.

If we cannot see your payment within 12 days after placing your order, your purchase will be canceled.

Prices and currency

The prices of the products shown on the website do not include VAT. VAT is automatically calculated at the time of the order summary upon checkout.

Shipping rates are currently free.

Prices are expressed in euro. If your local currency is different from the currency in which the prices are indicated, your bank will apply the exchange rate in effect on the date of purchase. Your bank may at its discretion apply a different exchange rate, beyond our control. Please note that changing the delivery country may have an influence on the price due to the currency exchange.

Total price

The total price specified on the final checkout screen includes taxes and shipping costs. The prices are also listed in the order confirmation receipt, printable or downloadable for any subsequent reference. If payment is made by credit card, the total amount of the order will be shown on the statement in the local currency.

Please make the transfer only for the amount due specified in the order confirmation and make a transfer for every single order, using the unique reference number shown in the order confirmation.

5 . SHIPPING AND DELIVERY

Delivery

Deliveries are made Monday through Friday. We do not deliver on public holidays.

Estimated delivery time

Our products are assembled by hand and created according to order specifications, therefore delivery will take place within 30 working days from the time of order.

You will be notified when your scissors are delivered to the courier. directly by e-mail or by phone.

Inspection upon delivery

Upon delivery, please check the packaging for any damage. If it seems to you that the products have suffered damage, we invite you not to accept the delivery and to communicate the non-acceptance by writing to ordini@cutterfly.com.

We will refund the purchase price as soon as the warehouse has registered the return of your shipment.

6 . CANCELLATIONS AND RETURNS

Cancellation of the order before delivery

It is possible to cancel any order relating to products free of charge and within 5 working days of order confirmation. After this period it will no longer be possible to cancel the order.

Write an email to ordini@cutterfly.com to request for order cancellation.

Return of defective products after delivery

You have the right to return the products that have been shipped to you if at the time of delivery they are affected by defects that make them unsuitable for the use for which they are intended or otherwise do not comply with the order.

You have 8 days from the moment of delivery to report defects or discrepancies by writing to ordini@cutterfly.com.

The rights recognized by the law are reserved. If your claim is justified, in the face of the return of the products it will be your right to obtain, at your choice, a refund of the purchase price or the replacement of products that are flawed or do not conform to the order.

Refund information

In case of return of the goods due to defects or discrepancies of the same, we will bear the shipping costs related to both delivery and return to our warehouse. Refunds will be made by bank transfer, you will need to provide your bank details to customer service at the beginning of the return process. The refund will be made directly to your account.

You will only receive the refund after the returned product is received and registered in our warehouse.

7 . CONDITIONS APPLICABLE TO PROMOTIONAL CODES (DISCOUNTS)

  • If used in accordance with these general conditions, a promotional code enables the user to take advantage of the promotion / discount for / or the purchase of a specific product or an order of multiple products only once during the period indicated on the said promotional code.
  • Promotional codes are strictly personal and non-transferable and can only be used for online purchases on the website. It is not allowed to sell, barter or give away a promotional code. It is forbidden to upload a promotional code or make available on any website or through any other offer to the public; It is also forbidden to distribute, sell or barter a promotional code. The use of promotional codes for commercial purposes is prohibited.
  • Only one promotional code can be used for each product and for each order. Promotional codes cannot be combined with any other special offer or promotion.
  • Promotional codes cannot be exchanged for cash.
  • Without prejudice to its other rights as a Professional Buyer, Evorive has the right to immediately invalidate a promotional code in the event that it has reason to suspect that it is being used in violation of the above or otherwise in an abusive manner.

8 . AVAILABILITY

Cutterfly scissors are the result of innovative industrial technology and are assembled and finished completely by hand. The production is linked to the processing times of the machines, the handcrafted finishing and the careful quality control carried out on each product.

Consequently, all product orders are subject to their availability, and the Seller reserves the right not to accept orders that it is unable to fulfill within the deadline indicated in the previous paragraph “Shipping and Delivery”. In this case, he will communicate to the Professional Buyer the different delivery date within which the order could be processed. The Contract will be considered finalized only if the Professional Buyer expressly accepts the different delivery term indicated by the Seller.

9 . VALIDITY OF OFFERS

The offers on the website are valid only when they appear on the site, unless the website indicates a different period of validity.

10 . RESPONSIBILITY

We are not responsible for any damage suffered by third parties as a result of the use of our products. We are not responsible for any damage suffered by the user as a result of incorrect use of our products.

11 . PROCESSING OF PERSONAL DATA

Pursuant to Article 13 of EU Regulation 2016/679 on privacy (hereinafter “GDPR”) we inform you that the owner of the personal data you provide by completing the form for the conclusion of a Contract is the s.r.l. Evorive, p. IVA 11567920019, with registered office in Via Grange Palmero, 135 – 10091 Alpignano (TO).

The data provided will be used for the execution of the Contract and therefore your consent is not required for such processing. Evorive will process your personal data with the aid of IT tools, also by means of personnel authorized for processing and any external managers appointed by the company and will keep them for the time strictly necessary for the execution of the Contract (data processors). Subsequently, your data will be kept for a further period of time coinciding with the statutory limitation period (10 years) or, if necessary, with a longer term (greater than 10 years), determined on the basis of legitimate business reasons / interests. (for example: pending litigation). Your data may be disclosed to independent owners other than Evorive to comply with legal obligations. In the cases provided for by the GDPR you have the right to ask the data controller for access to personal data and the correction or cancellation of the same or the limitation of the processing of data concerning you, as well as, in any case, the right to data portability. You can, always in the cases provided for by EU Regulation 2016/679, oppose to the processing of your data. Finally, you have the right to lodge a complaint with the Privacy Guarantor.

In order to exercise these rights, you can forward your requests to the owner by writing an e-mail to the following address: privacy@evorive.com.

Evorive s.r.l. may also use the e-mail coordinates provided by you at the conclusion of the Contract to send you promotional communications relating to products similar to those purchased by you. Even for this purpose, your consent is not required, but at any time you can request and obtain free of charge that Evorive does not make such use of your personal data, or ceases to do so, by sending an e-mail to the following address: privacy@evorive.com.
